OPINION BY WIEAND, J.: The issue in this appeal is whether an action for professional negligence against a surveyor and an engineer is barred by
a prior judicial denial of a motion to open a judgment confessed on a note given in payment of their professional fees. The
trial court held that the action for negligence was barred and entered summary judgment in favor of the surveyor and the engineer.
The claimant appealed. We reverse and remand for further proceedings.
